Terms of Service

1. Acceptance of Terms

By accessing or using the Forkfeed application and website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Forkfeed is a community-driven content platform that allows users to browse, discover, and save curated collections (“forks”) of visual and text content. Content is organized into a hierarchy of Forks, Feeds, Cards, and Variants. Users can save content, follow creators, and view their browsing history.

Forkfeed is a platform, not a publisher. All content displayed in Forkfeed is sourced from independent content servers operated by third-party creators, communities, or automated systems using the open-source forkfeed/v1 protocol. Forkfeed does not create, own, control, or endorse the content served through these backends.

3. User-Generated and Third-Party Content

The content you see in Forkfeed is created, hosted, and controlled by independent third-party operators on their own servers. Forkfeed does not store this content on its own infrastructure. Because content lives on external servers outside our direct control:

  • We cannot guarantee the accuracy, quality, safety, or legality of any content displayed through the Service.
  • We cannot instantly remove or modify content hosted on third-party servers. When content is reported, we can hide it from the Forkfeed app and forward removal requests to the server operator, but the actual removal from the operator's server depends on their response.
  • Content may change at any time without notice from Forkfeed, as it is managed entirely by backend operators.
  • Content may include user-generated material, AI-generated material, advertising, or promotional material placed by the backend operator.

You browse and interact with third-party content at your own risk. If you encounter content that is inappropriate, harmful, or violates these Terms, please use the in-app report feature so we can take action.

4. User Accounts

4.1 Account Creation

To use certain features of the Service, you must create an account using Apple Sign In. By creating an account, you represent that you are at least 13 years of age and that the information you provide is accurate.

4.2 Account Security

You are responsible for maintaining the security of your Apple ID, which is used to authenticate your Forkfeed account. You agree to notify us immediately of any unauthorized access to or use of your account.

4.3 One Account Per Person

Each Apple ID may be associated with one Forkfeed account. Creating multiple accounts is not permitted.

5. User Content and Data

5.1 Your Data

Your saved forks, cards, followed creators, view history, card likes, and profile information constitute your user data. You retain ownership of your user data and may delete it at any time through the app's Settings screen.

5.2 Public Information

Your profile name and avatar may be visible to other users. If you create and publish forks, that content will be publicly accessible to all users of the Service.

5.3 Engagement Data

When you view cards in a feed, basic engagement data (time spent viewing, which variants you viewed) may be sent to the third-party content server that hosts the card. This helps content creators understand how their content is consumed. See our Privacy Policy for details.

6. Content Reporting and Moderation

6.1 Reporting Content

You can report forks or creators you believe are inappropriate, harmful, or in violation of these Terms using the in-app report button. When reporting, you will be asked to select a reason for your report.

6.2 Our Response

We commit to reviewing all reports within 24 hours of submission. After review, we may take one or more of the following actions:

  • Hide the reported fork or content from the Forkfeed app.
  • Contact the content backend operator and request removal or modification of the content.
  • Remove the content backend entirely from Forkfeed.
  • Suspend or terminate the account of a user who violates these Terms.
  • Dismiss the report if the content does not violate these Terms.

6.3 Limitations

Because content is hosted on independent third-party servers, Forkfeed can hide content from the app but cannot directly delete or modify content on a third-party server. Removal from the operator's server depends on the operator's cooperation and response time. Forkfeed is not liable for any content displayed before it is hidden or removed.

6.4 Blocking

You may report creators whose content you find objectionable. Reported content will be reviewed per our moderation process.

7. Content Backend Operators

7.1 Initial Review

Forkfeed performs an initial review of content backends before making them available in the app. This review is a basic check and does not constitute ongoing monitoring or endorsement of the content.

7.2 Operator Responsibilities

If you operate a content backend connected to Forkfeed, you agree that:

  • You have the right to distribute the content you serve.
  • Your content does not violate applicable laws or the rights of third parties.
  • Your content must not include any material prohibited under Section 9 of these Terms, including but not limited to nudity or sexual content, graphic violence, hate speech, or content endangering minors.
  • You will maintain the availability and security of your server.
  • You are responsible for your own privacy practices regarding any data your server processes.
  • You are solely responsible for any advertising or promotional content included in your feeds.
  • You will respond to content removal requests from Forkfeed in a timely manner.

8. Push Notifications

The Service may send push notifications to your device if you opt in during setup or via your device settings. Notifications may include alerts about new forks, milestones, recommendations, and new followers.

Push notifications are optional. You can disable them at any time through your device's notification settings or the app's settings. We do not send advertising or third-party marketing content via push notifications.

9. Prohibited Uses

9.1 Prohibited Content

You may not upload, serve, or distribute content that falls into any of the following categories:

  • Sexual or nude content: Pornography, nudity, sexually explicit or suggestive material.
  • Violence or gore: Graphic violence, gore, or content that glorifies or incites violence.
  • Hate speech: Content that promotes hatred or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, or disability.
  • Harassment and bullying: Targeted abuse, threats, intimidation, doxxing, or content intended to degrade or shame individuals.
  • Child safety: Any content that exploits, endangers, or sexualizes minors. This includes real and AI-generated material. Violations will be reported to the relevant authorities.
  • Self-harm: Content that promotes, glorifies, or provides instructions for suicide, self-injury, or eating disorders.
  • Illegal activity: Content facilitating drug trafficking, weapons sales, fraud, terrorism, or any other illegal activity.
  • Misinformation: Deliberately false information about health, safety, or public emergencies. Deepfakes or manipulated media presented as real.
  • Spam: Repetitive, deceptive, or bulk unsolicited content designed to mislead users or manipulate platform metrics.

9.2 Prohibited Behavior

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
  • Scrape, crawl, or use automated means to access the Service without our express permission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Distribute malware, viruses, or other harmful software through the Service.
  • Circumvent or attempt to circumvent any access controls, rate limits, or security measures.

10. Intellectual Property

10.1 Forkfeed's IP

The Service, including its design, features, and original content, is owned by Mapheim AS and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express permission.

10.2 Open-Source Components

The forkfeed.server software and the forkfeed/v1 protocol are released under open-source licenses. Your use of these components is governed by their respective licenses, not these Terms.

10.3 Third-Party Content

Content served by third-party content backends remains the intellectual property of the respective content owners. Forkfeed does not claim ownership of third-party content.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of any content accessed through the Service, including content served by third-party content backends.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPHEIM AS (OPERATING AS FORKFEED) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of, or inability to access or use, the Service.
  • Any content obtained from the Service, including content from third-party content backends.
  • Unauthorized access, use, or alteration of your data.
  • Any conduct or content of any third party on or through the Service.

13. Indemnification

You agree to indemnify and hold harmless Mapheim AS (operating as Forkfeed) from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

14.1 By Forkfeed

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

14.2 By You

You may delete your account at any time through the app's Settings screen. Upon deletion, all your personal data will be removed within 30 days. Your Apple Sign In token will be revoked as part of the deletion process.

14.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at legal@forkfeed.app and attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Norway.

16. Apple and Google Platform Terms

If you access the Service through the Apple App Store or Google Play Store, the following additional terms apply:

  • These Terms are between you and Mapheim AS only, not with Apple Inc. or Google LLC. Mapheim AS, not Apple or Google, is solely responsible for the Service and its content.
  • Apple and Google have no obligation to furnish any maintenance and support services with respect to the Service.
  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price (if any). To the maximum extent permitted by law, Apple and Google have no other warranty obligation with respect to the Service.
  • Apple and Google are not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, consumer protection claims, or intellectual property claims.
  • Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the “Last updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
